How to use Magic Studio safely and legally

Using Magic Studio Responsibly

We’re excited to introduce Magic Studio – the first all-in-one suite of tools created to supercharge the way teams create and scale visual content with the powers of leading generative AI technology.

With great power comes great responsibility, and it’s important to use the innovations of Magic Studio responsibly. This guide is designed to help you do just that.

Magic Studio is also protected by Canva Shield - a robust collection of trust, safety, and privacy features designed to make our products commercially safe. Learn more about Canva Shield here.

Magic Studio Do’s

  • You can use AI-created works for personal and commercial purposes, as long as you comply with our AI Product Terms.
  • When using Magic Studio, use descriptive and generic prompts. For example, “a princess driving a red car” without mentioning specific characters or car brands.
  • When editing an image with AI features, ensure that you have rights to use the original image.

Magic Studio Don't's

  • Don’t reference known brands, characters, or people in your prompts (unless you have express permission).
  • Don’t seek to bypass our safety and moderation filters.
  • Don’t create deceptive or harmful content, such as fake news, misinformation, or any content that promotes hate speech, discrimination, or violence.

What to expect from Magic Studio

  • Anyone can get similar results to you, if they use similar prompts. This means that we can’t guarantee your AI-created work will be unique to you.
  • As between you and Canva, you own your AI-created works. However, depending on where you live, AI-created works may not receive copyright protection. This means that you still can use it, but you may not be able to stop others from using it too.
  • When sharing AI-created content, it's best practice to disclose that it was created with the assistance of AI, like Magic Studio. This helps maintain transparency and fosters trust among your audience.

What can I use Magic Studio for?

You can use Magic Studio’s features for a wide range of personal and commercial purposes as long as you comply with our AI Product Terms.

  • Use Magic Media to create images and videos to wow your audience with a visually stunning presentation, or design images to print and sell merchandise like t-shirts and mugs

  • Use Magic Write to inspire you with the right words for your next blog post, press release, or even a poem

What should I keep in mind when using Magic Studio?

Magic Studio is an amazing partner in the creative process to create exciting new works. Remember, you are ultimately responsible for the content you create.

Here are some general guidelines to keep in mind when using Magic Studio. For more details, please read our AI Product Terms.

Review all AI-generated work

When using Magic Studio, it’s crucial to respect the rights of others. While Canva Shield includes a number of strict trust and safety tools, it’s important to review the content you generate and check that it doesn’t contain any third-party material or anything that could be considered inappropriate.

Don’t reference famous brands, characters, or people (without their permission)

It’s important to ask for permission before using works that belong to others. Don’t use Canva’s AI features to try and generate images of existing brands, characters, or people unless you have their permission to do so.

Ensure you have the rights to use the original image when editing

Magic Studio allows you to edit your own images with the powers of generative AI. As always, it’s important that you have the rights to use and edit any images you upload into Canva. You can also use images from the Canva library, and yes, even make edits to AI-created images!

When editing photos of a recognizable person, it’s important to obtain their permission to use their image.

Give credit to your AI co-author

When sharing AI-created content, it's best practice to disclose that it was created with the assistance of AI, like Magic Studio. This helps maintain transparency and fosters trust among your audience.

For example, if you’re publishing a book that was co-written by Magic Write - let your audience know about it by adding a mention to the first page, or captioning a photo you’ve edited with Magic Edit. You may just inspire your audience to harness the power of Magic Studio in their own work!

Don’t create deceptive or harmful content

Follow our AI Safety Policy, which includes our Acceptable Use Policy. Do not use our platform, including our AI-powered features, to create deceptive or harmful content. We also explicitly have an Anti-Discrimination clause and will take action to block accounts that attempt to engage in this behavior. Please “be a good human”, and always exercise your best judgment.

Don’t bypass our trust and safety systems

Our AI-powered features come with multiple layers of safety measures as part of our commitment to building a safe and trusted environment, and keeping our community safe.

We’re continuously improving these systems, but at times they may result in false positives. In the event you encounter anything that doesn’t look right, please help us improve by reporting any issues.

As between you and Canva, to the extent permitted by law, you own the AI-created content you create using our features. However, whether that content benefits from copyright protection will depend on the laws of your local jurisdiction.

Currently, many jurisdictions (including the US) do not give copyright protection to AI-created works. This position applies to generative AI as a whole, and is not specific to Canva or Magic Studio.

This means you can still use your AI-created works, but you may be limited in your ability to stop other people from using or copying these works. We recommend seeking local legal advice if you have any questions about how this might impact your planned use.

Can I trademark AI-created content?

Canva’s AI features can be a great way to get inspiration for a trademark - for example, you can ask Magic Write to help you to come up with a list of business name ideas. However, before you apply to register a trademark, it is important to do searches to make sure that the name you’ve chosen is available to use.

Keep in mind that when using AI features, other users may use similar prompts to you that result in similar outputs. This means we can’t guarantee that your AI-created works are unique to you and they may not be suitable to use as a trademark - you want your brand to stand out from the crowd!

We recommend seeking advice from a trademark attorney if you want to use an AI-created name or graphic as a trademark.
